I. Main Responsibility

According to the law, supervise and inspect the behaviors of marketing competition, deal with the cases of monopoly, unfair competition in the marketing transaction; investigate and deal with the smuggling in the circulation area; deal with the behaviors of producing and distributing the adulterated or counterfeit goods; strike the illegal behavior of pyramid-selling and disguised pyramid-selling; investigate and deal with other economic illegal cases and implement the administrative penalty according to laws.

II. Administrative Penalty

1、To the unfair competition behaviors, the administrative authorization for commerce and industry can give the administrative penalty complying with the laws and articles of Anti-unfair Competition Act and Zhejiang Province Anti-unfair Competition Regulation:

①The business confusion behaviors of arbitrarily use the name, packing and decoration specially owed by others’ famous productions.

②The behaviors of deceitfully prize-winning purchase, the maximum premium of lucky draw type prize-winning purchase exceeding RMB5,000;

③Business corrupting behaviors;

④The behaviors of infringing others’ business confidential;

⑤Limit competition behaviors of government sectors, utility plant and other operators legally possessing the monopolizing status;

⑥Unfair alliance behaviors;

⑦The misunderstanding untrue propagandizing behavior;

⑧Other unfair competition behaviors

2、To the speculation and profiteering, the administrative organ for commerce and industry can give administrative penalty complying with the Provisional of Administrative Penalty of Speculation and Profiteering and its detailed rules.

According to the circumstance of the speculation and profiteering done by executives and directly responsible personnel, respectively impose a fine, and suggest the related department to give the administrative penalty.

3、To behaviors of engaging in producing and distributing the adulterated or counterfeit goods, the administrative organ for commerce and industry can give administrative penalty complying with the laws and articles of Product Quality Law, Trademark Act, Zhejiang Province Dealing with the behaviors of Producing and Distributing the Adulterated or Counterfeit Goods Provision.

4、To behaviors of disobeying the national laws, articles and regulations referring to management of import and export goods, protection of intellectual property, pyramid-selling and disguised pyramid-selling, wildlife conservation, tobacco monopoly, food sanitation, gold and silver control, control of the cultural market, real estate management and so on, the administrative organ for industry and commerce gives relevant penalty complying with the function and power of related laws, articles and regulations.
