(Ⅰ) Main responsibilities
Supervise and manage the issuance and operating activities of various advertisements, investigate and handle false and illegal advertisement according to the law, be responsible for the approval of advertisement business.
(Ⅱ) Transact License of Advertising Business
1、To apply for the registration of advertising business, obtain Registration Form of Advertising Business by Notice of Prior Approval of Enterprise Name released by provincial administration for industry and commerce, fill in it according to the content and submit the following documents:
①Registration form of advertising operating company with complete contents;
②Certificate of designated representative of all shareholders or common authorized proxy;
③Articles of corporation;
④Certificate of shareholder qualification;
⑤Notice of Prior Approval of Enterprise Name
⑥Certificate of site for business operation;
⑦Diploma certificate of advertising employees;
⑧Report on the verification of capital
⑨Other relevant certificate documents
2、To apply for network advertising business, the following materials shall be submitted:
①Registration form of advertising operating company with complete contents;
②Duplicate of corporate capacity;
③Articles of company;
④Registration certificate of domain name of website (effective duplicate);
⑤Business license approved by the telecommunication administration of province, autonomous region, municipality directly under the Central Government or department in charge of information industry of State Council;
⑥Diploma certificate of advertising employees;
⑦Other relevant certificate materials
3、To apply for concurrent advertising business, traditional media company shall submit the following materials:
①Registration form of advertising operating company;
②Certificate of consigned proxy and ID card duplicate of the consignee;
③Articles of company;
④Duplicate of certificate of legal person;
⑤Duplicate of the publication license of newspaper and periodical or the license of TV station and broadcasting station to open frequency channel;
⑥Certificate of site for business operation;
⑦Diploma certificate of advertising employees;
⑧Certificate of establishment of advertisement department;
⑨Other relevant certificate materials
4、Transaction procedure and time limit
After submitting complete materials, review and obtain approval, sign consent opinion on the written application of business corporation to ensure the enterprise to receive the business license of business corporation; License of Advertising Business is directly issued to concurrent advertising institution after approval.
Possess the qualifications of advertising business and it will be dealt with and finished within 5 working days from the day of acceptance.
(Ⅲ)License of temporary advertising business
1、In case of requiring temporary advertising business during certain specific period or the process of certain activity, it shall be undertaken by the sponsor of the activity to consign advertising operating company. As to large scale activity agreed by people’s government above the province, after the approval of provincial administration for industry and commerce, temporary advertising operating organization may be set up to undertake the activity themselves.
2、To apply for temporary advertising business, the organizer shall put it forward 30 days prior to the holding day of the activity. The following documents and certificates must be submitted:
①Application report signed by the principal of application company of advertising business including contents such as time, place, scope, collection terrain, charge standard of advertising business;
②Letter of authorization that the sponsor of the activity consigns advertising operating company to undertake the advertising business and the agreement on both parties’ rights and obligations;
③Feasibility report on the legality and public welfare of this activity lodged by the sponsor;
④Document of approval for feasibility report by relevant government authority;
⑤License of advertising business;
⑥Name list of advertising professionals of temporary advertising operating organization and advertising managerial system;
⑦Budget statement of funds recognized by the sponsor and organizer;
⑧Other documents and certificates stipulated by the laws and regulations of advertising management shall be submitted.
3、Time limit for transaction: Complete certificate documents are submitted. The decision to approve or not approve shall be made within 5 working days from the day of acceptance. Issue the License of Temporary Advertising Business to approved temporary advertising business.
(Ⅳ) Examination and approval of intermediary service advertising on self-funded study abroad
1、Before issuance, intermediary service advertising on self-funded study abroad must be approved by provincial administration for industry and commerce.
2、Declaration conditions and material details:
①Written application;
②Business License, qualification cognizance certificate of intermediary service organization of self-funded study abroad approved by education department in charge of State Council;
③Cooperating protocol concerning self-funded study abroad of Chinese citizen (Chinese version) signed by intermediary service organization put on records and stamped by education department in charge above the province level with overseas colleges and universities, education institutions;
④Sample of advertising;
⑤Other certificate documents to confirm the truth and legality of the advertising;
⑥As for consigning advertising company as deputy, business license of this company, letter of authorization of intermediary service organization
3、Approved time limit: 5 working days
(Ⅴ) Approval of advertising of intermediary activity of entry and exit due to personal reason
1、Advertising of intermediary activity of entry and exit due to personal reason must be approved by provincial administration for industry and commerce or authorized municipal administration for industry and commerce before issuance.
2、Declaration conditions and material details:
①Written application;
②Business license of intermediary organization, Business License of Intermediary Activity of Entry and Exit due to Personal Reason;
③Cooperative agreement (Chinese version) directly signed by intermediary organization confirmed by local public security organ above county and municipal level of the place of intermediary organization with foreign relevant service organization;
④Sample of advertising;
⑤Other certificate documents to confirm the truth and legality of the advertising;
⑥As for consigning the advertising company as deputy, business license of this company, letter of authorization of intermediary service organization
3、Approved time limit: 5 working days
(Ⅵ) Service advertising of intermediary activity of overseas employment
1、Service advertising of intermediary activity of overseas employment must be approved by provincial administration for industry and commerce before issuance.
2、Declaration conditions and material details:
①Written application;
②Business license of intermediary organization, Business License of Intermediary Activity of Overseas Employment;
③Cooperative agreement (Chinese version) directly signed by intermediary organization confirmed by local public security organ above county and municipal level of the place of intermediary organization with foreign relevant service organization;
④Sample of advertising;
⑤Other certificate documents to confirm the truth and legality of the advertising;
⑥As for consigning the advertising company as deputy, business license of this company, letter of authorization of intermediary service organization
3、Approved time limit: 5 working days
(Ⅶ) Administrative penalty
As for false advertising actions violating the law, industrial and commercial administrative authority shall give administrative penalty in terms of relevant laws, regulations and rules such asAdvertising Law and Regulations on Controlling Advertising.
